Terms of Service

Welcome to CamSpam. These Terms of Service ("Terms") govern your use of the CamSpam mobile application ("App") provided by Palovisto LLC ("we," "us," or "our"). By downloading, installing, or using CamSpam, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using CamSpam, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

CamSpam is a photo management application that helps you organize your camera roll by identifying and managing temporary or "spam" photos such as screenshots, receipts, and documents. The App uses artificial intelligence to analyze and categorize your photos.

3. User Accounts and Subscriptions

CamSpam offers both free and premium subscription tiers:

Free Tier: Basic photo scanning and organization features with limited functionality.
CamSpam Max: Premium subscription with unlimited scanning, extended retention periods, and advanced features.

Subscriptions are billed through Apple's App Store. By subscribing, you agree to Apple's terms of service for in-app purchases. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

4. Privacy and Data Handling

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your data.

            Important: CamSpam uses AI-powered image analysis to classify your photos. When you enable AI classification, your photos are securely transmitted to our AI service provider for analysis. Photos are processed in real-time and are not stored on external servers. You can disable AI classification at any time in Settings.
        

5. User Responsibilities

You agree to:

Use the App only for lawful purposes
Not attempt to reverse engineer, modify, or create derivative works of the App
Not use the App to process illegal or harmful content
Maintain the security of your device and account
Be responsible for all photos you choose to delete through the App

6. Photo Deletion and Data Loss

CamSpam provides tools to delete photos from your device. Deleted photos cannot be recovered by CamSpam. You are solely responsible for:

Reviewing photos before deletion
Maintaining backups of important photos
Understanding that photos moved to CamSpam are removed from your Camera Roll

We recommend enabling iCloud Photo Library or another backup service before using CamSpam's deletion features.

7. Intellectual Property

CamSpam and all associated content, features, and functionality are owned by Palovisto LLC and are protected by international copyright, trademark, and other intellectual property laws. You retain all rights to your photos.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

The AI classification will be 100% accurate
The App will be uninterrupted or error-free
Any errors will be corrected

You acknowledge that AI-based photo classification may occasionally misclassify photos. Always review suggestions before deleting.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PALOVISTO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PHOTOS, OR PROFITS, ARISING FROM YOUR USE OF THE APP.

10. Indemnification

You agree to indemnify and hold harmless Palovisto LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15. Apple-Specific Terms

If you are using the App on an Apple device:

These Terms are between you and Palovisto LLC, not Apple Inc.
Apple has no obligation to provide maintenance or support for the App
Apple is not responsible for any claims related to the App
Apple is a third-party beneficiary of these Terms
